Your agreement with Costa Rica Dream Adventures

By signing our reservation form or clicking “I Agree” on our website, you agree to the following terms and conditions: Costa Rica Dream Adventures, a division of Duluth Travel, Inc., a Georgia corporation (“we” or “us”) arranges the trip described or named on your confirmation form (the “Trip”).

1. Prices

Your Trip will be a package consisting of one or more hotels and at least one additional ground service such as local transportation and tours. We do not provide breakdowns of the total package price. We cannot confirm hotel space until we receive your initial payment. Alternate hotels will be offered in the event the hotel you select is not available.

Trip prices are per person and are based on a minimum of two travelers. Costa Rica airport departure taxes of $29.00 USD, per person, are not reflected in any of the prices quoted. MOst major airlines include this tax into their tickets.

2. Reservation and Payments

• We require a $100 non-refundable deposit to confirm your Trip. A higher deposit may be required for select hotels.
• Prices are subject to changes due to modification of Costa Rican tax law.
• Travel Seasons: Our prices and payment deadlines vary depending on the season of the departure and completion of your Trip.

Low Season May 1 - June 30 / Sept. 1 - Nov. 30
High Season Jan. 6 – April 30* / July 1 – Aug. 31 / Dec. 1 – Dec. 19
Peak Season Dec. 20 – Jan. 5 and Easter week

* Except for Easter week (Palm Sunday through Easter Sunday).

Our final payment deadlines are as follows:
• Low Season: Final payment is due 35 days before departure.

• High Season: Final payment is due 50 days before departure.

• Peak Season: Final Payment is due 90 days before departure.

For any reservation requested in a shorter period than the days above, full payment has to be made immediately.

Payments can be made by agency check or by credit card only. Visa, MasterCard, American Express & Discover cards are accepted. For credit card payments, a Credit Card Authorization form must be completed, signed and faxed to 770-813-8303. All charges will be billed by Duluth Travel, Inc. (Costa Rica Dream Adventures is a division of Duluth Travel). Additionally, a surcharge of 3% of the total charge of the trip may be assessed for all credit card purchases.

3. Changes by You

• No penalties will apply if modifications are made up to 35 days prior to departure. However, If the modification increases the Trip price, you will pay the difference.

• Allowed modifications: change of travel dates, change of room category, modifications on transportation and/or changes on tours. Reservations are subject to availability.

• Any additional services not mentioned in the program as included will have an additional cost.

• On site confirmed services are not exchangeable for other activity and if not taken the activity there will be no refund.

4. Cancellation by You

Enjoy peace of mind vacation planning. We strongly recommend getting travel insurance including the “canceling for any reason benefit” for travelers to enjoy stress-free vacation planning. If you have to cancel your Trip, the following penalties will apply, unless one of the Covid-19 exceptions below apply. We must receive written notice of your cancellation either via certified mail to Costa Dream Adventures, Inc. 2860 Peachtree Industrial Blvd., Suite 1000, Duluth, GA 30097, overnight courier, or e-mail sent to info@costaricadreamadventures.com (with a confirmation of receipt from us). The day we receive your notice will count as the date of your cancellation.

• Low Season: Cancelations made up to 35 days prior to departure will have the deposit as penalty. Cancelations made 34 days or less prior to departure will have a 100% penalty.

• High Season: Cancelations made up to 50 days prior to departure will have the deposit as penalty. Cancelations made 49 days or less prior to departure will have a 100% penalty.

• Peak Season: Cancelations made up to 90 days prior to departure will have the deposit as penalty. Cancelations made 89 days or less prior to departure will have a 100% penalty.

COVID-19 related cancelation policies

In the event that:
(a) a quarantine rule or country closure rule for Costa Rica or the United States changes between the time of your initial payment and the Trip start date and such change would require you to quarantine upon arrival and/or return and you don’t wish to travel, you must notify us within seven (7) days of the rule going into effect, or
(b) you test positive for Covid-19 within 14 days before your Trip start date and provide us with proof of your test result,
a voucher with the total value of the trip will be issued under the name of the original passenger(s) and will be valid for twelve months from the time the voucher was issued. The voucher will be valid only for the hotels and services that were confirmed in the original program, is not exchangeable, and cannot be broken down into multiple trips.

For Non-COVID-19 related cancelations, the General Terms and Conditions will apply accordingly to the travel season. We strongly recommend getting travel insurance including the canceling for any reason benefit for travelers to enjoy a stress-free vacation planning.
• Force majeure: Costa Rica Dream Adventures cannot be liable for the loss of any service contracted (partial or total loss) caused by or consequences of change of schedule of international flights, loss of international flights, negligence and/or arbitrary acts of the clients, acts of God, or any other situation not under our direct control.

5. Postponement by Us

We reserve the right to postpone your Trip for reasons beyond our control including any event named in the Risks of Travel section below. You may decline to participate in the postponed Trip, in which case we will refund to you, within 90 days after you notify us of your decision, any refunds that we receive from our suppliers during the 90-day period. The rescheduled Trip will be subject to the terms and conditions of this Agreement. Except as set forth in this Section 5, we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever.

6. Requirements to Enter Costa Rica

For entry to Costa Rica, U.S. citizens must have a valid passport and return ticket to exit Costa Rica within 90 days. US passports must be valid for one day before entering Costa Rica.
While in Costa Rica, all U.S. citizens must carry proof of identification at all times. Citizens of non-U.S. countries, please consult local consulates.
US nationals cannot stay more than 90 days as a tourist.

7. Forms of Payment

Payments can be made by check or by credit card only. Visa, MasterCard, American Express & Discover cards are accepted. For credit card payments, a Credit Card Authorization Form must be completed, and signed. All charges will be billed by Duluth Travel, Inc. (Costa Rica Dream Adventures is a subsidiary of Duluth Travel)

8. Agent for Suppliers

We act as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, bus operator, or other service provider named in your itinerary or confirmation (“Suppliers”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

9. Risks of Travel and Release

We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TRIP OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE.

10. Claims Deadline and Exclusive Jurisdiction

You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that this Agreement shall be governed by Georgia law without regard to conflict of laws principles. You agree that the state courts in Gwinnett County, Georgia, will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

JURISDICTION AND VENUE
Costa Rica Dream Adventures, Inc. is headquartered in the state of Georgia, County of Gwinnett. You agree that the terms of use shall be governed by the laws of the State of Georgia, without regard to principles of conflict of laws. You also agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed only in the state courts located in Gwinnett County and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
