Your agreement with Costa Rica Dream Adventures

By signing our reservation form or clicking "I Agree" on our website, you agree to the following Terms and Conditions: Costa Rica Dream Adventures LLC, a Georgia limited liability company ("we," "us," or "Costa Rica Dream Adventures"), arranges the trip described or named on your confirmation form (the "Trip").

1. Prices

Your Trip will be a package consisting of one or more hotels and at least one additional ground service such as local transportation and tours. We do not provide breakdowns of the total package price. We cannot confirm hotel space until we receive your initial payment. Alternate hotels will be offered in the event the hotel you select is not available.

Trip prices are per person and are based on a minimum of two travelers. Costa Rica's departure tax is included in most airline tickets. If a traveler's airline ticket does not include the applicable departure tax, the traveler is responsible for paying it directly as required.

2. Reservation and Payments

• We require a minimum $100 non-refundable deposit to confirm your Trip. Certain hotels, services, travel dates, or reservations may require a higher deposit and/or more restrictive payment and cancellation terms. Any such requirements will be communicated before confirmation and will apply to that reservation.
• Prices are subject to changes due to modification of Costa Rican tax law.
• Travel Seasons: Our prices and payment deadlines vary depending on the season of the departure and completion of your Trip.

Low Season May 1 - June 30 / Sept. 1 - Nov. 30
High Season Jan. 6 – April 30* / July 1 – Aug. 31 / Dec. 1 – Dec. 19
Peak Season Dec. 20 – Jan. 5 and Easter week

* Except for Easter week (Palm Sunday through Easter Sunday).

Our final payment deadlines are as follows:
• Low Season: Final payment is due 35 days before departure.

• High Season: Final payment is due 50 days before departure.

• Peak Season: Final Payment is due 90 days before departure.

For any reservation requested in a shorter period than the days above, full payment has to be made immediately.

Payments may be made by agency check, bank transfer, or credit card. Visa, MasterCard, American Express, and Discover cards are accepted. Credit card payments may be submitted through our secure online payment systems. Bank transfers must be made according to the payment instructions provided by Costa Rica Dream Adventures LLC. All bank, intermediary, currency conversion, and other transfer fees are the responsibility of the sender, and Costa Rica Dream Adventures LLC must receive the full invoiced amount. All payments and charges will be billed by or payable to Costa Rica Dream Adventures LLC.

Acceptance of these Terms and Conditions applies to the entire reservation and to all payments made toward the reservation, including the initial deposit, installment payments, additional payments, and final payment. By submitting any subsequent payment, the traveler acknowledges that the payment remains subject to these Terms and Conditions, including the applicable payment, cancellation, and refund policies.

3. Changes by You

• Requests for modifications made more than 35 days prior to departure will be accommodated when possible and are subject to availability and applicable Supplier terms, fees, penalties, and price differences. If a modification increases the Trip price or results in Supplier-imposed fees or penalties, the traveler is responsible for the additional amount.

• Allowed modifications: change of travel dates, change of room category, modifications on transportation and/or changes on tours. Reservations are subject to availability.

• Any additional services not mentioned in the program as included will have an additional cost.

• On site confirmed services are not exchangeable for other activity and if not taken the activity there will be no refund.

4. Cancellation by You

We strongly recommend purchasing travel insurance, including Cancel for Any Reason coverage when available and appropriate. If you cancel your Trip, the following cancellation penalties will apply. We must receive written notice of your cancellation by email at info@costaricadreamadventures.com, by text message at 770.308.7082, or by fax at 470.995.3560. A cancellation will be considered received only when Costa Rica Dream Adventures LLC confirms receipt. The date of our confirmation will be considered the effective date of cancellation.

• Low Season: Cancelations made up to 35 days prior to departure will have the deposit as penalty. Cancelations made 34 days or less prior to departure will have a 100% penalty.

• High Season: Cancelations made up to 50 days prior to departure will have the deposit as penalty. Cancelations made 49 days or less prior to departure will have a 100% penalty.

• Peak Season: Cancelations made up to 90 days prior to departure will have the deposit as penalty. Cancelations made 89 days or less prior to departure will have a 100% penalty.

5. Postponement by Us

We reserve the right to postpone your Trip for reasons beyond our control including any event named in the Risks of Travel section below. You may decline to participate in the postponed Trip, in which case we will refund to you, within 90 days after you notify us of your decision, any refunds that we receive from our suppliers during the 90-day period. The rescheduled Trip will be subject to the terms and conditions of this Agreement. Except as set forth in this Section 5, we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever.

6. Requirements to Enter Costa Rica

Travelers are solely responsible for ensuring that they meet all passport, visa, immigration, health, vaccination, and other entry and exit requirements applicable to their nationality and individual circumstances. Entry requirements and permitted lengths of stay may change and are determined by the appropriate government and immigration authorities.

Travelers should verify current requirements with the appropriate government authorities before travel. Costa Rica Dream Adventures LLC is not responsible for denied entry, missed travel, additional expenses, or other losses resulting from a traveler's failure to comply with applicable entry or exit requirements.

7. Travel Insurance

We strongly recommend that travelers purchase travel insurance to protect their Trip. Travel insurance options may be available through Costa Rica Dream Adventures LLC or from independent insurance providers. Coverage, eligibility, exclusions, deadlines, and benefits vary by policy and provider. Travelers are responsible for reviewing the applicable policy documents and determining whether the coverage is appropriate for their needs.

Certain policies may offer a Cancel for Any Reason ("CFAR") benefit subject to eligibility requirements, purchase deadlines, coverage limits, exclusions, and other policy terms. Please refer to the applicable insurance policy for current terms and conditions.

8. Agent for Suppliers

We act as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, bus operator, or other service provider named in your itinerary or confirmation (“Suppliers”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

9. Risks of Travel and Release

We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TRIP OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE.

10. Claims Deadline and Exclusive Jurisdiction

You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that this Agreement shall be governed by Georgia law without regard to conflict of laws principles. You agree that the state courts in Gwinnett County, Georgia, will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

COSTA RICA DREAM ADVENTURES, INC. SHALL NOT BE LIABLE FOR ANY DAMAGES, LOST PROFITS, INJURIES, SAVINGS, OR GOODWILL RESULTING FROM YOUR USE OR INABILITY TO USE INFORMATION PROVIDED HEREIN. You should therefore verify information obtained from this document before you act upon it, as applicable.

JURISDICTION AND VENUE
Costa Rica Dream Adventures, Inc. is headquartered in the state of Georgia, County of Gwinnett. You agree that the terms of use shall be governed by the laws of the State of Georgia, without regard to principles of conflict of laws. You also agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed only in the state courts located in Gwinnett County and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
